If you don’t have the time or the flexibility from your work or responsibilities at home, if you are incarcerated, or if you are disabled, you may not be able to go to an in-person meeting at a law office, even if it is near you. For these reasons, you may need a service that can provide assistance in bankruptcy by phone.
It is possible for the a law office to help you completely by phone, but the main concern is usually the 341a Meeting (also known as the Creditor’s Meeting or Meeting of Creditors), which is the only time you need to go to court throughout the whole process. If you are capable and able to attend this meeting, it is required for a debtor to attend the 341a Meeting in order to complete a bankruptcy to discharge. There are some other options. Your attorney can file a motion to excuse the debtor from the 341a Meeting, but many supporting documents may be requested if it is for medical reasons or incaceration. It is not easy to get excused from this meeting. So, as long as your bankruptcy attorney can attend this meeting with you, you can do everything else by phone if necessary.
