Past clients of ours have experienced a Home Owners Association or HOA attempting to foreclose on their homes due to past due debt. We have also heard of HOAs placing liens on homes due to past due debt. A bankruptcy can eliminate past HOA debt. We have helped several clients with this issue in the past. A bankruptcy can include any past due HOA debt, but will not eliminate or close the account if you are still the owner of the home. So, just as an example, if you have $1,000 past due debt to your Home Owners Association, a bankruptcy can eliminate the $1,000 of past due debt, but the account will still continue to charge you your monthly association dues. In closer detail, let’s say you filed your bankruptcy petition with us in January 2012. Any past due debt to your HOA prior to January 2012 will be eliminated from your debt through the bankruptcy protection in a Chapter 7 filing, but the HOA will still be charging you at your normal dues rate for the month of January and continue to charge your normal dues while you own the property.
